How Do I Fire My Realtor?

Q: I listed my house with a Realtor and now I have changed my mind about selling it. She threatened me with the listing agreement I signed with her. I never got a copy of the agreement and now she Is threatening me. I have asked her twice to come \get her sign and return my key nicely. Now I am mad. What should I do?

A: You should consider speaking with her Broker/Office Manager or report her to the local Association of Realtors. I am assuming you have met with her and have asked her to cancel the listing agreement because you are no longer interested in selling. Nobody can force you to sell your house. You may not have copies of the contract (for whatever reason, although you should have requested copies) but if you do remember signing a contract then she may use it agains you if you decide to list your house with another agency/agent during the contract period you contracted her (3 months, 6 months, a year?). The best thing you can do is to request a copy of the signed agreement (or any documents) you signed with her to see what it is that you actually agreed to and go from there. As I said, no one should force you to sell your house but if you do have a written listing agreement signed by you and this listing agent, you can still ask her to cancel the listing since you don't want to sell after all. However, you will probably face some challenges if you decide to list with someone else during the time you were suppose to be in contract with this particular agent.

A: Go to her broker…run quickly and tell the broker that you have asked her to discontinue the listing. Just go in her office and ask who the owner of that branch is/ or the office manager. Best wishes.

A: Call her employing broker at her office and complain. Call the Arizona Association of Realtors and make a complaint. They will direct you to the local board of Realtors to make the grievance. By the way, even if she found 1000 buyers willing to buy your place, neither her or the contract can force you to sell your home at this point. The Realtor is being foolish. Please make your grievance known to the appropriate people suggested so that this Realtor's unprofessional behavior may be corrected.

A: Call the local board of realtors and her broker – first of all , she is in violation by not giving you a copy of the listing agreement.

Put firing her in writing and get it to her broker too.

A: The listing agreement you signed is actually not with your agent. It's with the company where she has her license, and you can cancel it at any time with written notification. If that doesn't get her off your back, you have a couple of options. The first, and easiest would be to call her broker. The Designated Broker of any real estate company is ultimately responsible for the actions of every real estate agent in their employ. That should take care of it. If not, complain to your local board of Realtors. I think though that once you have spoken with the broker, you will be okay.

A: If you hired someone to do a job for you (sell your house in this case) you are both bound by the terms of the contract you both signed. One party to most any contract can't void or change the terms of that agreement without the consent of the other party. In other words you can't "fire" your Realtor without her consent. As a public relations practice I will generally release a seller from our listing agreement if they have either changed their minds about selling or become unhappy with me for some reason.

A: If your Realtor is just a sales person, then contact the broker of her company she works for, that is the actual person who is ultimately representing you, tell him or her what has happend and they will help you do what is best for your situation . You are suppose to receive a copy of anything that you sign when you sign it. A: A listing agreement is a contract, and must be honored until the date it expires. Usually though, a letter from an attorney will be enough to persuade the agent to release you from your contract.

The other issue is that by law you must receive copies of any contract that you sign with an agent. If the agent did not give you a copy then that agent could be in violation of contract and/or licensing law. I don't know the laws in AZ, but i am sure they are similar to Mass where I am located.

A: Occasionally it happens that a seller has a change of heart and wishes to withdraw the listing. At that time, the contract can only be cancelled by mutual agreement. The agent may have had expenses marketing the home (ads, fliers etc) and you could offer to reimburse her out-of-pocket expenses. If you truly did not get a copy of the listing agreement, the agent is at fault for not giving one to you. I also suggest you contact the agent's brokerage firm to discuss the matter and explain why you do not wish to continue with the listing. If you are unhappy with the agent, another agent could be assigned to you to continue the listing. If you truly do not want to sell the house, explain the reason. The agent can legally hold you to the signed contract, but from a practical point, she would be spinning her wheels because she would encounter obstacles at every step with an uncooperative seller.
